Recognizing Justice For Citizens With Cognitive Disabilities engages with the most prominent liberal theories of justice today in revealing the path toward equal justice for citizens with cognitive disabilities.

Political theory is a field that finds nourishment in others. From economics, history, sociology, psychology, and political science, theorists have drawn a rich repertoire of schemas to parse the social world and make sense of it. With each of these encounters, new subjects are brought into focus as others recede into the background, ushering a change not only in how questions are tackled but also in what questions are thought worth asking.

This paper describes student outcomes from participating in a week-long out-of-school action civics program designed to increase students’ civic and political competence and engagement. Using analysis from four years of survey data, this paper presents findings related to changes in students’ civic competence as a result of participating in the program, including findings related to both first time and repeat campers. Data revealed that participants experienced gains in half of the civic competence construct variables, with first-time campers experiencing significant gains (...) in five of the civic competence construct variables. Data analysis suggests that iEngage, an action civics summer experience, was effective in increasing elements of students’ civic competence, including their ability to get people to care about a problem, organize and run a meeting, write an opinion letter or contact a media outlet to express their views, and contact an elected official or community leader to address an issue. It summarises the ground covered to date and provides a comprehensive (...) review of the literature on the characterises, use and limitations of CSR assurance services. It develops a conceptual model which distinguishes between determinants of CSR assurance at the national- and firm-level and shows how the nature of assurance services, a company’s reporting infrastructure and current technologies of assurance enable or constrain the benefits of having CSR disclosures assured. The first major section of the Critique of Pure Reason, the Transcendental Aesthetic, is concerned with the nature of space and time, and with the nature of our representation of them. In interpretations of this part of the Critique, there is a very widespread tendency to present Kant’s discussion of space as attempting to establish that the representation of space is a condition for individuating or distinguishing objects, and that it is on this basis that Kant establishes the apriority of (...) this representation. I believe that this way of interpreting the Aesthetic is wholly misguided. The interpretive tendency I have in mind takes a number of different forms. On one approach, the role of space is to allow us to distinguish objects even if they are qualitatively identical. This represents Kant as making a certain kind of anti-Leibnizian point, one that concerns Leibniz’s principle of the identity of indiscernibles. On another approach, space—or something closely analogous to space—is regarded as essential on account of its role in allowing us to re-identify objects over time. Interpretations of Kant that follow the second approach are largely inspired by Strawson’s discussions of these matters in chapter 2 of Individuals. (shrink)

Since the late 1990s, the use of contralateral prophylactic mastectomy to treat unilateral breast cancer has been on the rise. Over the past two decades, dozens of studies have been conducted in order to understand this trend, which has puzzled and frustrated physicians who find it at odds with efforts to curb the surgical overtreatment of breast cancer, as well as with evidence-based medicine, which has established that the procedure has little oncologic benefit for most patients. Based on the work (...) of Annemarie Mol and John Law, this paper argues that these efforts to understand increased CPM use are limited by the “epistemology problem” in medicine, or, in other words, the tendency to view healthcare controversies and decision making exclusively through the lenses of objective and subjective forms of knowledge. Drawing on public discourse about rationales for choosing CPM, we argue that this surgical trend cannot adequately be understood in terms of what doctors and patients know about breast cancer risk and how CPM affects that risk. In addition, it must be recognized as the outcome of how specific practices of screening, detection, and treatment do or enact the bodies of patients, producing tensions in their lives that cannot be remedied with better or better communicated information. Recognizing the embodied realities of these enactments and their effects on patient decision making, we maintain, is essential for physicians who want to avoid the paternalism that haunts breast cancer treatment in the US. This paper presents the relationship between pedagogical content knowledge and political/ideological clarity as a framework for understanding the nuanced interpretations and applications of critical social studies pedagogy and practice. Using a qualitative case study research design, this study explores the decision-making process of two novice social studies teachers as they decide if and how to utilize critical historical inquiry within their classrooms. Findings indicate that teachers’ use of critical historical inquiry is informed by their subject area consciousness and political and (...) ideological clarity which is cultivated through personal, schooling, and communal experiences. However, we also find that a teacher's pedagogy is significantly strengthened when political and ideological clarity are coupled with pedagogical content knowledge to ensure a more developed enactment of critical historical inquiry is reached within the social studies classroom. Summary The object of this study is to analyse certain aspects of the debate between David Brewster and William Whewell concerning the probability of extra-terrestrial life, in order to illustrate the nature, constitution and condition of natural theology in the decades immediately preceding the publication in 1859 of Charles Darwin's Origin of species. The argument is directed against a stylised picture of natural theology which has been drawn from a backward projection of the Darwinian antithesis between natural selection and certain (...) forms of the design argument. Contrary to the popular image of natural theology as an essentially static, autonomous and monolithic set of presuppositions about the existence of design in nature, the paper underlines the existence of a fundamental divergence of strategies within natural theology, a divergence that, in the case of Brewster and Whewell, can be correlated with the religious cultures to which they most closely belonged. The fact that, in the plurality of worlds debate, their respective positions became mutually exclusive suggests that the fragmented and disordered state of natural theology, only too apparent before the Darwinian impact, was occasioned as much by the ulterior problem of rationalising the excessive space of the astronomers and the excessive time of the geologists as it was by any principle of the uniformity of nature in the biological sphere. The argument is substantiated with particular reference to the breakdown in communication as Brewster and Whewell developed conflicting strategies to expose the ?development hypothesis? that had appeared in Vestiges. Their altercation also reveals a certain conflict of status concerning the conclusions of astronomy and geology which, in turn, suggests that tensions between the physical and life sciences were not peculiar to the period following the publication of Darwin's theory. The purpose of this survey was to gather individual’s attitudes and feelings towards privacy and the selling of data. A total (N) of 1,107 people responded to the survey. -/- Across continents, age, gender, and levels of education, people overwhelmingly think privacy is important. An impressive 82% of respondents deem privacy extremely or very important, and only 1% deem privacy unimportant. Similarly, 88% of participants either agree or strongly agree with the statement that ‘violations to the right to privacy are (...) one of the most important dangers that citizens face in the digital age.’ The great majority of respondents (92%) report having experienced at least one privacy breach. -/- People’s first concern when losing privacy is the possibility that their personal data might be used to steal money from them. Interestingly, in second place in the ranking of concerns, people report being concerned about privacy because ‘Privacy is a good in itself, above and beyond the consequences it may have.’ -/- People tend to feel that they cannot trust companies and institutions to protect their privacy and use their personal data in responsible ways. The majority of people believe that governments should not be allowed to collect everyone’s personal data. Privacy is thought to be a right that should not have to be paid for. (shrink)

Background: The current study was designed to examine whether ethnic-racial identity moderated the relationship between disordered eating and primary ethnic identification.Methods: Three hundred and ninety-eight undergraduate women were recruited from a large university in Hawai‘i. Participants completed the Eating Disorder Examination Questionnaire, the ERI measure, and reported their primary ethnicity as an index of ethnicity.Results: There was a significant correlation between eating concerns and centrality, r = 0.127, p < 0.05. Moderation analyses indicated that only ERI centrality moderated the predictive (...) effect of ethnicity on the importance of eating concerns, b = 0.05, t = 2.37, p = 0.018.Conclusions: The results suggest that the relationship between self-reported primary ethnicity and EDEQ scores is greater when ethnicity is more central to the individual's identity or when the in-group affect is important to an individual. Findings underscore the need for further research on the underlying mechanisms that account for the differing ways that ERI may affect eating concerns. (shrink)

The mature Marx does draw on Romantic ideas at crucial moments; but rather than reinforcing an image of Marx as an intolerant ideologue, the Romantic element in his thought, properly construed, suggests theoretical (...) openness and humility before an unmasterable reality. In The life of Richard Owen by his grandson there is an inference to the effect that Owen had objected to his name being used to authorize various statements that Whewell was drafting in opposition to the Vestiges. The inference is drawn from letters that Whewell wrote to Owen on 13 and 15 February 1845. Corroboration of this would corne from a letter of Owen to Whewell, dated 14 February 1845, if extant. Among the Whewell papers at Trinity College, Cambridge, (...) there are several letters from Owen to Whewell, none of which bears that date. There is one, however, dated 14 February 1844 which, on doser inspection, turns out to be the missing link in their correspondance. The evidence for the misdating is not merely that the letter falls naturally into a later sequence. The conclusion is inescapable because Owen refers to an ‘opinion which I have always entertained, and still do strongly, on the subject of a refutation of “Vestiges”’. Since the first edition of Chambers's book did not appear until October 1844, the letter must belong to the following year. My object in this paper is to examine the implications of this letter for a reconstruction of Owen's attitude to that book which Adam Sedgwick could so detest for, among many things, its ‘gross views of physiology’. We use a reverse Easton forcing iteration to obtain a universe with a definable well-order, while preserving the GCH and proper classes of a variety of very large cardinals. This is achieved by coding using the principle ◊ $_{k^ - }^* $ at a proper class of cardinals k. By choosing the cardinals at which coding occurs sufficiently sparsely, we are able to lift the embeddings witnessing the large cardinal properties without having to meet any non-trivial master conditions.

Background and Objectives People living with dementia have historically been excluded from qualitative research and their voices ignored due to the perception that a person with dementia is not able to express their opinions, preferences and feelings. Research institutions and organizations have contributed by adopting a paternalistic posture of overprotection. Furthermore, traditional research methods have proven to be exclusionary towards this group. The objective of this paper is to address the issue of inclusion of people with dementia in research and (...) provide an evidence-based framework for dementia researchers based on the five principles of human rights: Participation, Accountability, Non-discrimination and equality, Empowerment and Legality (PANEL). Design This paper adapts the PANEL principles to the research context, and uses evidence from the literature to create a framework for qualitative research in people with dementia. This new framework aims to guide dementia researchers in designing studies around the needs of people with dementia, to improve involvement and participation, facilitate research development and maximize research outcomes. Results A checklist is presented with questions related to the five PANEL principles. These questions cover ethical, methodological and legal issues that researchers may need to consider while developing qualitative research for people with dementia. Conclusions The proposed checklist offers a series of questions and considerations to facilitate the development of qualitative research in patients with dementia. It is inspired by current human rights work of recognized dementia researchers and organizations who have been directly involved in policy development. Future studies need to explore its utility in improving participation, facilitating ethics approvals and ensuring that outcomes are relevant to people with dementia. (shrink)

Vopěnka’s Principle is a natural large cardinal axiom that has recently found applications in category theory and algebraic topology. We show that Vopěnka’s Principle and Vopěnka cardinals are relatively consistent with a broad range of other principles known to be independent of standard (ZFC) set theory, such as the Generalised Continuum Hypothesis, and the existence of a definable well-order on the universe of all sets. We achieve this by showing that they are indestructible under a broad class of forcing constructions, (...) specifically, reverse Easton iterations of increasingly directed closed partial orders. The new methods, the tone, and new taste are clearly discernible first in the early articles and books of John Crowe Ransom, Allen Tate, R. P. Blackmur, Kenneth Burke, and Yvor Winters, and somewhat later in Cleanth Brooks, Robert Penn Warren, and William K. Wimsatt. . . . Still, something tells us that there is some sense in grouping these critics together. Most obviously they are held together by their reaction against the preceding or contemporary critical schools and views (...) mentioned before. They all reject the kind of metaphorical, evocative criticism practiced by the impressionists. Tate, Blackmur, Burke, and Winters contributed to a symposium highly critical of the neo-Humanists, and others voiced their rejection elsewhere. They all had no use for Mencken and Van Wyck Brooks, particularly after Brooks became a violent enemy of all modernism. Furthermore, they were almost unanimous in their rejection of Marxism, with the single exception of Kenneth Burke, who in the thirties passed through a Marxist phase and, anyhow, after his first book moved away from his neo-critical beginnings. What, however, in the American situation mattered most was that they were united in their opposition to the prevailing methods, doctrines, and views of academic English literary scholarship. There, in a way the younger generation may find it difficult to realize, a purely philological and historical scholarship dominated all instruction, publication, and promotion. I remember that when I first came to study English literature in the Princeton graduate school in 1927, fifty years ago, no course in American literature, none in modern literature, and none in criticism was offered. Of all my learned teachers only Morris W. Croll had any interest in aesthetics or even ideas. Most of the New Critics were college teachers and had to make their way in an environment hostile to any and all criticism. Only Kenneth Burke was and remained a freelance man of letters, though he taught in later years occasionally at Bennington College and briefly at the University of Chicago. But he very early deserted the New Criticism. It took Blackmur, Tate, and Winters years to get academic recognition, often against stiff opposition, and even Ransom, R. P. Warren, and Cleanth Brooks, established in quieter places, had their troubles. Ransom's paper "Criticism, Inc." pleaded for the academic establishment of criticism, and thanks to him and others criticism is now taught in most American colleges and universities. But it was an uphill fight. I still remember vividly the acrimony of the conflict between criticism and literary history at the University of Iowa, where I was a member of the English Department from 1939 to 1946. René Wellek, Sterling Professor Emeritus of comparative literature at Yale University, is the author of Theory of Literature and of A History of Modern Criticism, 1750-1950. Perception solves computationally demanding problems at lightning fast speed. It recovers sophisticated representations of the world from degraded inputs, often in a matter of milliseconds. Any theory of perception must be able to explain how this is possible; in other words, it must be able to explain perception's computational tractability. One of the few attempts to move toward such an explanation has been the information encapsulation hypothesis, which posits that perception can be fast because it keeps computational costs low by (...) forgoing access to information stored in cognition. I argue that we have no compelling reason to believe that encapsulation explains (or even contributes to an explanation of) perceptual tractability, and much reason to doubt it. This is because there exist much deeper computational challenges for perception than information access, and these threaten to make the costs of access irrelevant. If this is right, it undermines a core computational motivation for encapsulation and sends us back to the drawing board for explanations of perceptual tractability. (shrink)

The 18th-century French political theorist the Baron de Montesquieu described honour as the ‘principle’ – or animating force – of a well-functioning monarchy, which he thought the appropriate regime type for an economically unequal society extended over a broad territory. Existing literature often presents this honour in terms of lofty ambition, the desire for preference and distinction, a spring for political agency or a spur to the most admirable kind of conduct in public life and the performance of great deeds. But it also seems to involve quite a bit of what the contemporary philosopher Aaron James calls ‘being an asshole’, and the article will explore what happens to Montesquieu’s political theory of monarchy – which is foundational for an understanding of modern politics – when we reverse the usual perspective and consider it through the lens of the arsehole aristocracy. We present a new partial order for directly forcing morasses to exist that enjoys a significant homogeneity property. We then use this forcing in a reverse Easton iteration to obtain an extension universe with morasses at every regular uncountable cardinal, while preserving all n-superstrong , hyperstrong and 1-extendible cardinals. In the latter case, a preliminary forcing to make the GCH hold is required. Our forcing yields morasses that satisfy an extra property related to the homogeneity of the partial order; we (...) refer to them as mangroves and prove that their existence is equivalent to the existence of morasses. Finally, we exhibit a partial order that forces universal morasses to exist at every regular uncountable cardinal, and use this to show that universal morasses are consistent with n-superstrong, hyperstrong, and 1-extendible cardinals. This all contributes to the second author’s outer model programme, the aim of which is to show that L-like principles can hold in outer models which nevertheless contain large cardinals. (shrink)

What does it mean to know oneself, and what is the self that one hopes to know? This article outlines the implications of an embodied understanding of persons and some aspects of the “self” that are generally ignored when thinking about our selves. The Cartesian model of body–soul dualism reinforces the idea that there is within us a soul, or self, or mind that is our hidden, inner, and real self. Thus, the path to self-knowledge is introspection. The alternative view (...) is that persons are embodied, embedded, and at times extended. This article emphasizes the bodily, active, contextual, relational, often simulated, and sometimes extended nature of the selves that we are, and that we hope to know. (shrink)

Proclaiming Louis Pasteur as the “Founder of Stereochemistry”, the distinguished Scottish chemist, Crum Brown, addressing a late nineteenth-century audience of Edinburgh savants, drew attention—as Pasteur had incessantly done—to the intimate relationship between living organisms and the optical activity of compounds sustaining them. It seemed to Crum Brown “that we must go very much further down in the scale of animate existence than Buridan's ass, before we come to a being incapable of giving practical expression to a distinct preference for one (...) of two objects differing only in being one to the right and the other to the left”. Crum Brown's lecture must have been entertaining, but it was also motivated by a serious desire to do justice to a particular assertion of Pasteur—an assertion which had, moreover, been misunderstood and dismissed by no less a chemical genius than Wilhelm Ostwald. Writing at a time when the majority of his colleagues were stressing the resemblances between inorganic and organic compounds, Pasteur had insisted that he “could not point out the existence of any more profound distinction between the products formed under the influence of life and all others” than that “artificial products have … no molecular asymmetry”. Pasteur was obliged to concede that the chemist might produce enantiomorphic pairs of isomers, but without resorting to a manual separation of crystals he was powerless to imitate Nature's performance, powerless to fabricate by chemical means a separate optical isomer, divorced from its partner. Now it was not only Crum Brown who felt that chemists had brushed aside this proposition of Pasteur. In his 1898 Presidential Address to the chemical section of the British Association, Professor F. R. Japp also complained that the possible vitalistic implications of Pasteur's distinction between natural and artificial products had been misapprehended or tacitly ignored. (shrink)

This paper develops two prescriptive standards — the Expectation and Reputation guidelines — that may help businesspeople avoid violating clearly accepted truth standards. The guidelines also assist in determining whether truth is required in circumstances where honesty seems in conflict with the practical demands of business. A discussion of why, when and how these guidelines may be applied to facilitate truth-telling by business (...) organizations follows, along with illustrative examples. (shrink)

For thirty years now there has been considerable debate concerning the foundations of modern natural law theory, with Richard Tuck emphasising the role self-preservation plays in anchoring Grotius's system and his critics pointing to the contribution of a principle of sociability. With reference to recent contributions in the literature on Stoicism from Julia Annas, A. A. Long and Tad Brennan, I argue that Grotius's use of the outline of Stoic ethics from Book III of Cicero's De finibus is crucial for (...) understanding the nature of his argument. Drawing on Cicero's presentation of the Stoics' oikeiosis helps Grotius to generate an argument which issues not in any demand for altruism, charity or mutual aid, but rather for organising justice around very strong protections for private property. The argument remains one about human sociability, however, and ought not to be mistaken for an account of self-interest, nor for a doctrine with substantially Epicurean roots. (shrink)

Abstract The primary purpose of this essay is to review Nidhal Guessoum's Islam's Quantum Question from a perspective outside Muslim tradition. Having outlined the main contours and contentions of the book, general issues are raised concerning the reconciliation of religious belief with the sciences. Comparisons are drawn between the resources available to Christian and Muslim cultures for achieving reconciliation, with particular reference to scriptural exegesis and natural theology. Speculative questions are then raised concerning possible differences between the Christian and Islamic (...) experience and whether these may shed any light on the facilitation in Europe of an enduring scientific movement.
